Understanding Legal Separation: Legal separation is a formal process where a married couple decides to live apart but remains legally married. Courts can step in to divide responsibilities such as child custody, child support, and property use. Even though the couple is no longer living together, the marriage itself is still intact. This means neither person is free to remarry. In many cases, couples choose separation instead of divorce for personal, financial, or religious reasons. It can also serve as a trial period to decide if divorce is the right choice. Legal separation agreements can be as detailed as divorce agreements, covering finances, debts, and parenting plans.
